TERMS & CONDITIONS
Last updated: September 2026
1. ABOUT THESE TERMS
These Terms & Conditions apply to memberships and participation at RISEN Jiu Jitsu Pty Ltd (ABN 20 701 005 370) (“RISEN”, “we”, “us” or “our”).
By joining RISEN, the Member, or the parent or legal guardian responsible for a Member under 18, agrees to these Terms & Conditions together with any applicable waiver, policies and reasonable academy rules.
RISEN memberships are ongoing and have no minimum contract term unless expressly stated otherwise at the time of joining.
For Members under 18, the parent or legal guardian who enters into the membership is responsible for the membership, including payments, cancellation, suspension and compliance with these Terms.
2. MEMBERSHIP PLANS
RISEN may offer different membership plans, including memberships based on a specified number of classes per week and Unlimited memberships.
A 2x Weekly membership allows the Member to attend up to two eligible classes during each training week, running from Monday to Sunday.
Unused classes do not automatically carry over or accumulate.
RISEN may, at its discretion and subject to class availability, allow a reasonable make-up class where a Member has missed a scheduled class. Make-up classes are not guaranteed, do not have a cash value and do not create an ongoing entitlement to accumulated classes.
Unlimited memberships allow attendance at eligible classes appropriate to the Member’s age, program and experience level, subject to the current timetable, class capacity and reasonable academy requirements.
Memberships are personal to the Member and cannot be transferred to another person.
3. MEMBERSHIP FEES AND BILLING
The applicable membership fee is the fee disclosed to and accepted by the Member at the time they join or change membership plan.
Membership fees are billed weekly in advance on Mondays using RISEN’s nominated payment system.
Where a membership begins before the Member’s first Monday billing date, the Member may train without charge until that first billing date.
Membership fees remain payable unless the membership has been validly suspended or cancelled in accordance with these Terms.
Members are responsible for keeping their payment details current and ensuring that sufficient funds are available for scheduled payments.
4. FAILED PAYMENTS
If a scheduled payment is unsuccessful, RISEN or its payment provider may continue to attempt to collect the outstanding payment during this period.
RISEN does not charge its own late payment fee.
Where an account remains unpaid for 14 days, RISEN may suspend the Member’s access to classes until the account is brought up to date.
Suspension of access due to non-payment does not waive or cancel amounts already outstanding.
RISEN may contact the Member or responsible parent or legal guardian to assist in resolving an outstanding account.
5. CHANGING MEMBERSHIP PLANS
Members may request to change their membership plan at any time.
Unless otherwise agreed by RISEN, a membership plan change will take effect from the next weekly billing cycle.
The membership fee applicable to the new plan will be the fee disclosed and agreed to when the change is made.
Where a Member moves between age-based programs, including from a Kids & Youth program to an Adult program, the membership and applicable rate may be adjusted to reflect the program in which the Member is participating. RISEN will provide reasonable notice where a change in membership fee applies.
6. MEMBERSHIP SUSPENSIONS
Members may request to temporarily suspend their membership.
Membership suspensions:
are charged at $5 per week;
must be for a minimum of one week;
may generally be used for a maximum of eight weeks in any rolling 12-month period;
must ordinarily be requested at least seven days in advance; and
cannot ordinarily be applied retrospectively.
Members cannot participate in classes while their membership is suspended.
RISEN may approve additional or shorter-notice suspension periods in exceptional circumstances, including significant injury, illness or other circumstances considered reasonable by RISEN.
Suspension preserves the Member’s active membership status and applicable membership rate, including any applicable Founding Member status.
7. CANCELLATION
RISEN memberships are ongoing and have no minimum contract term unless expressly stated otherwise.
A Member may cancel their membership by providing at least 14 days’ written notice to RISEN.
Cancellation requests must be sent to:
The membership remains active during the notice period and normal membership fees continue to apply during that period.
Cancellation takes effect at the end of the applicable notice period once all amounts due have been paid.
Verbal conversations with an instructor, coach or staff member do not constitute a cancellation request.
Nothing in this section limits any cancellation or other rights that cannot lawfully be excluded under the Australian Consumer Law.
8. FOUNDING MEMBERSHIPS
RISEN may offer Founding Memberships to a limited number of Members as part of its opening offer.
A Founding Member’s agreed membership rate will remain locked while the Founding Membership remains continuously active, subject to these Terms.
An approved membership suspension does not end the Member’s Founding Member status.
If a Founding Membership is cancelled, the Founding Member rate and associated Founding Member benefits are lost. If the person later rejoins RISEN, the membership rates and offers available at that time will apply.
Eligible Founding Members receive the Rise Together Kit associated with their Founding Membership. Where an appropriate size or item is temporarily unavailable, fulfilment may be delayed until suitable stock becomes available.
9. MEMBERSHIP FEE CHANGES
RISEN may change membership fees from time to time.
Where a fee change applies to an existing Member, RISEN will provide at least 30 days’ written notice before the new fee takes effect.
A Member who does not wish to continue at the new fee may cancel their membership in accordance with these Terms before the new fee takes effect.
Any specific price protection expressly provided as part of a Founding Membership will continue to apply while that Founding Membership remains eligible for that protection.
10. TIMETABLES, CLASSES AND PROGRAMS
RISEN may reasonably change its timetable, class times, instructors, class formats, programs and class availability from time to time.
Membership does not guarantee that a particular class, instructor or class time will remain permanently available.
RISEN will aim to communicate significant timetable or program changes to Members within a reasonable period.
Classes may also be subject to capacity limits, age requirements, experience requirements or other reasonable safety and operational requirements.
11. PUBLIC HOLIDAYS AND SCHEDULED CLOSURES
Membership fees continue during public holidays, scheduled holiday periods and reasonable temporary closures forming part of RISEN’s normal annual operations.
RISEN may operate a reduced timetable, offer open mats or alternative classes, or close for reasonable periods during the year, including during the Christmas and New Year period.
Scheduled closures and timetable reductions of this nature do not automatically entitle a Member to a refund, credit or reduction in membership fees.
Where an unexpected event causes a material or prolonged interruption to RISEN’s ability to provide services, RISEN may make reasonable alternative arrangements having regard to the circumstances.
Nothing in this section limits any rights or remedies available under the Australian Consumer Law.
12. MISSED CLASSES AND MEMBER ABSENCES
Membership fees are payable for access to the applicable RISEN membership program and are not calculated on a per-class basis.
A Member’s personal absence, holiday or failure to attend a class does not automatically entitle the Member to a refund, credit or reduction in membership fees.
Members who expect to be away for a period may request a membership suspension in accordance with these Terms.
RISEN may permit reasonable make-up classes in accordance with Section 2, but make-up classes are not guaranteed and do not accumulate as ongoing credits.
13. MEMBER CONDUCT, SAFETY AND ACADEMY RULES
RISEN is committed to providing a safe, respectful and welcoming training environment.
Members, parents, guardians and visitors must comply with reasonable academy rules and directions relating to safety, conduct, hygiene, equipment, uniforms and use of the training facility.
RISEN may take reasonable action where conduct threatens the safety, wellbeing or experience of Members, staff or visitors.
This may include restricting participation, suspending access or terminating a membership in circumstances involving serious or repeated misconduct, including violence, bullying, harassment, abusive behaviour, deliberate damage, dangerous conduct, serious or repeated breaches of academy rules, or continued non-payment.
RISEN may take immediate action where reasonably necessary to protect the safety or wellbeing of Members, staff or visitors.
Where reasonably appropriate, RISEN will consider the circumstances before taking such action.
14. CHILDREN AND YOUNG PEOPLE
For Members under 18, the parent or legal guardian responsible for the membership agrees to these Terms on behalf of the child or young person and is responsible for membership payments and administration.
Members must participate in the program appropriate to their age and circumstances as reasonably determined by RISEN.
When a Member moves into another age-based program, including from Kids & Youth to Adults, the applicable membership plan and fee may change in accordance with Section 5.
Parents and legal guardians must comply with reasonable directions relating to the safety, supervision and collection of children participating at RISEN.
15. WAIVERS, HEALTH AND PARTICIPATION
Participation in Brazilian Jiu Jitsu and related physical activities involves inherent risks.
Members must complete any applicable participation agreement, risk warning, waiver or other document required by RISEN before participating.
Members, or their parent or legal guardian where applicable, are responsible for providing relevant information that may reasonably affect safe participation and for updating RISEN if relevant circumstances change.
RISEN may reasonably restrict or modify a Member’s participation where necessary for safety.
These Terms operate together with RISEN’s applicable participation agreements, waivers, Privacy Policy and reasonable academy rules.
16. REFUNDS AND CREDITS
RISEN does not ordinarily provide refunds or credits for change of mind, personal holidays, missed classes or periods where a Member chooses not to attend while their membership remains active.
Where appropriate, Members may use the membership suspension arrangements set out in these Terms.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law.
17. COMMUNICATIONS
RISEN may communicate with Members, parents and legal guardians regarding memberships, payments, timetable changes, academy operations and other matters relevant to participation.
Members are responsible for keeping their contact information current.
Notices from RISEN may be provided by email or through RISEN’s membership management system using the contact details associated with the Member’s account.
Cancellation requests must be submitted in writing to hello@risenjiujitsu.com.au.
18. QUESTIONS, CONCERNS AND COMPLAINTS
RISEN encourages Members, parents and legal guardians to raise questions or concerns so they can be addressed promptly and fairly.
Membership enquiries, concerns or complaints may be sent to:
RISEN Jiu Jitsu Pty Ltd
Email: hello@risenjiujitsu.com.au
RISEN will consider concerns raised and aim to respond within a reasonable period.
19. AUSTRALIAN CONSUMER LAW
These Terms are intended to operate consistently with the Australian Consumer Law and other applicable laws.
Nothing in these Terms is intended to exclude, restrict or modify any guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
If any provision of these Terms is found to be invalid or unenforceable, that provision may be read down or severed to the extent necessary, without affecting the remaining provisions.
20. CHANGES TO THESE TERMS
RISEN may update these Terms from time to time where reasonably necessary to reflect changes to its operations, services, legal requirements or membership arrangements.
RISEN will provide reasonable written notice of any material change that adversely affects an existing Member’s rights or obligations.
Where a material change has a significant adverse effect on an existing Member, the Member may cancel their membership by written notice before the change takes effect.
Changes will not retrospectively remove rights that have already accrued.
The current version of these Terms will be published on RISEN’s website and will show the date it was last updated.
